Colorado enacted significant legislation in 2023 and employers must be prepared. This session will address the new Protecting Opportunities and Workers' Rights (POWR), which enacts far-reaching changes to Colorado law, including a lower threshold for harassment claims. Also, Colorado further limited confidentiality and nondisclosure agreements; added robust recordkeeping requirements; restricted asking for most age-related information in hiring; redefined the posting requirements under its broad Equal Pay for Equal Work Act; and expanded the rights of public sector workers. At the same time, federal agencies have crafted new rules subjecting employers to even more scrutiny and potential violations of law. Finally, the U.S. Supreme Court has changed the landscape of work with its recent rulings, including ending affirmative action in higher education. This is a must-attend session for human resources and legal professionals
